Terms of Service

These Terms of Service (“Terms”) govern your use of prospeaksolutions.com (the “Site”) and your communications with ProSpeak Solutions (“ProSpeak,” “we,” “us” or “our”), based in Mill Creek, Washington, USA. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Our services

ProSpeak provides corporate presentation-skills training, including on-site, virtual and destination workshops. The Site describes our services for information only. Workshops and other services are provided under a separate written proposal, statement of work or agreement with your organization (a “Service Agreement”). If a Service Agreement conflicts with these Terms, the Service Agreement controls for the services it covers, including pricing, scheduling, cancellation and payment.

2. Use of artificial intelligence (AI)

We use AI tools from third-party providers in parts of our business, and we want you to know how:

• Website and blog content may be drafted or edited with the help of AI and is reviewed by our team before publication.
• Emails and outreach messages we send may be drafted with AI assistance and are reviewed and sent by a member of our team.
• Research and organization: we use AI to help research businesses, organize contact lists, summarize information and analyze the performance of the Site.

Because AI tools can make mistakes, AI-assisted content may occasionally contain errors or omissions despite our review. Content on the Site is general information about presenting and communication; it is not professional, legal, medical or financial advice, and you should use your own judgment before relying on it. We do not use AI to make decisions about you that produce legal or similarly significant effects. Please do not submit confidential or sensitive information through the Site’s forms. Our Privacy Policy explains how AI tools handle personal information.

3. Using the Site

You agree to use the Site only for lawful purposes. You will not:

• attempt to gain unauthorized access to the Site, its servers or any connected system;
• interfere with the Site’s operation, including by introducing malware or overloading it;
• use automated tools to scrape, copy or harvest content or data from the Site without our written permission;
• submit false, misleading, unlawful or abusive information through our forms; or
• use the Site or its content to train machine-learning or AI models without our written permission.

4. Intellectual property

The Site and its content, including text, graphics, logos and images, and our workshop curriculum, exercises and materials, are owned by ProSpeak or its licensors and protected by copyright, trademark and other laws. You may view and print pages from the Site for your own personal or internal business use. You may not copy, reproduce, distribute, modify, sell or create derivative works from our content or workshop materials without our written permission. Workshop participants may keep and use the materials they receive for their own professional development.

5. Information you submit

When you submit information through the Site (for example, through our contact or newsletter forms), you confirm that it is accurate and that you have the right to provide it. We handle that information as described in our Privacy Policy. If you send us ideas or feedback, we may use them without any obligation to you.

6. Communications

If you contact us or sign up for our newsletter, you agree that we may reply by email or phone and, for the newsletter, send you periodic updates. You can stop marketing emails or calls at any time by using an unsubscribe link where provided, replying to ask us to stop, telling us during a call, or emailing info@prospeaksolutions.com.

7. Third-party links and services

The Site may link to or use third-party websites and services, such as Google Analytics and Google reCAPTCHA. We do not control and are not responsible for third-party content, products or practices, and your use of them is governed by their own terms.

8. No guarantee of results

Our training is designed to help people present and communicate more effectively, but results depend on many factors, including each participant’s effort and practice. We do not guarantee any specific outcome, such as winning business, a promotion or a particular performance result.

9. Disclaimer

THE SITE AND ITS CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PROSPEAK WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SITE OR ITS CONTENT. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). Liability for workshops and other services is governed by the applicable Service Agreement. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless ProSpeak and its owners, employees and contractors from any claims, damages and expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or your violation of these Terms.

12. Governing law and disputes

These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in Snohomish County, Washington, and you consent to the jurisdiction of those courts.

13. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page with a new effective date. Your continued use of the Site after changes are posted means you accept the updated Terms.

14. General

If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce any provision is not a waiver. These Terms, together with our Privacy Policy and any Service Agreement, are the entire agreement between you and us about the Site.
